Lunch and Rest Breaks

When Is My Lunch Break?

The California Education Code and Personnel Commission Rules and Regulations provide a meal period for employees who work a minimum number of hours per day.

According to Personnel Commission Rule 10.1.6, “all employees who are scheduled to work over six (6) consecutive hours per day shall be assigned an unpaid, uninterrupted meal period of at least thirty (30) minutes to a maximum of one (1) hour. The meal period shall be assigned at or about the midpoint of each work shift. This provision does not apply to employees working six (6) hours or less, or assigned to a split shift.”

As indicated, this rule provides a meal period for employees who work more than six (6) hours a day. However, this does not prohibit the District from providing a meal period to employees who work less than six (6) hours.

When Is My Rest Break?

According to Personnel Commission Rule 10.1.7, “each employee shall be allowed a fifteen (15) minute rest period during any four (4) hour working period, which is not interrupted by a meal period or similar break.”

Rule 10.1.7 further stipulates that these rest periods should be taken at the assigned school or work site, which “insofar as practicable, shall be in the middle of each work period, but scheduled no later than prior to the last hour of the employee’s work day.”

Transfer Request

PC Rule 11.1.1.1 defines a transfer as “a relocation of an employee to the same class in a different department or job site or to a related classification within the same salary range.” An employee may request transfer to a different work assignment within the same classification.

An employee seeking a voluntary transfer may submit a request for transfer on the approved form to the Personnel Commission Office (PC Rule 11.1.9). Transfer Requests are valid for six (6) months and eligible only to employees who have successfully passed probation in that classification.

By submitting a transfer request, an employee has the right to interview, but is not guaranteed the position. “Whenever the appointing authority requests an eligibility list to fill an existing vacancy in a classification, the Director-Personnel Commission shall also submit the appropriate transfer and reinstatement list (if any),” along with the top three ranks from the eligibility list. “The appointing authority may fill a vacant position by either a selection from the transfer and reinstatement list or eligibility list.” (PC Rule 11.1.10).

Release Time for District Interviews

Whether an employee is looking to promote or transfer to another position, he or she must interview with the hiring administrator at the school site or department. Personnel Commission Rule 15.14.2 states that “a regular classified employee shall be provided with release time to participate in interviews for district promotions or transfers during his/her regular working hours without deduction of pay or other penalty. The employee shall provide his/her supervisor with notice of the need for release time as soon as possible after notification from the Personnel Commission Office,” school site or department.
