CALL TO ORDER
The meeting was called to order by Dr. Klonecky at 3:30 p.m.

APPROVAL OF MINUTES --Regular Meeting of April 5, 2005 and Special Meeting of April 12, 2005
Mr. Busch moved, seconded by Dr. Griffith, that the Minutes of the Regular Meeting of April 5, 2005 and the Special Meeting of April 12, 2005 be approved. Motion carried 3/0.
PUBLIC HEARING -- PERSONNEL COMMISSION BUDGET
Dr. Klonecky opened the Public Hearing -- Personnel Commission for questions or comments concerning the Personnel Commission Budget for 2005-2006.Hearing no comments, Dr. Klonecky requested a motion to close the hearing.Dr. Griffith moved, seconded by Mr. Busch, that the Public Hearing -- Personnel Commission be closed. Motion carried 3/0.
APPROVAL OF PERSONNEL COMMISSION BUDGET -- 2005-2006
Mr. Busch moved, seconded by Dr. Griffith, that the Personnel Commission Budget, 2005-2006 be approved. Motion carried 3/0.
APPROVAL OF ELIGIBILITY LIST -- CAMPUS SECURITY
Mr. Busch moved, seconded by Dr. Griffith, that the Eligibility List -- Campus Security be approved. Motion carried 3/0.
DISCUSSION OF THE TORRANCE UNIFIED SCHOOL DISTRICT PERSONNEL COMMISSION MERIT SYSTEM PROCESS
Ms. Koga noted that in response to Commissioner Busch's request, a comparison study of the custodian examination process was completed by Commission staff. The ten comparison districts outlined in the Local 99 contract were contacted concerning their testing process for this position.The following individuals addressed the Personnel Commission concerning the recruitment process of custodians:
(1) Alejandro Vargas, Substitute Custodian
(2) Isidora Herrera, Local 99 Shop Steward
(3) Arturo Antimo, Substitute Custodian
(4) Arthur Alvarez, Substitute Custodian
(5) Alicia Loncar, Local 99 Representative
Suggestions included substituting their substitute custodial experience in lieu of testing, the acceptance of completion of a 60-hour custodial course in lieu of testing, and the acceptance of recommendations from administrators in lieu of testing.Ms. Koga noted that the Commission usually receives in excess of 200 applications for this position and the testing process provides a non-biased process in which to select qualified candidates.Alicia Loncar, Local 99 Representative, added that there was a concern among custodians concerning the lack of supplies needed to properly perform the duties of their position. Ms. Koga referred her to District administration.

Ms. Koga noted that pursuant to Personnel Commission Rule 2.5.1, the Commissioners were in a receipt of a proposed operating budget for 2005-2006 prior to April 1. Additionally, Rule 2.5.2 stipulates that the Commission shall provide a public hearing on its proposed budget no later than May 30.The Commissioners then designated Tuesday, April 12, 2005, 3:30 p.m. as the public hearing on the Proposed Personnel Commission Budget, 2005-2006 in the District Board Room.Ms. Koga then referred to the memorandum dated March 31, 2005 referencing Noon Aide Appointments-21st Century Program (Attachment #1) emphasizing the need (under Personnel Commission Rule 9.1.2 Payroll Review) for certifying the payroll.Dr. Klonecky commended staff and encouraged the continuance and protection of the Merit System process.
Mr. Busch referenced the recent Daily Breeze article dated March 23, 2005 in which "Marcia Ventura, a spokeswoman for the Los Angeles County Registrar-Recorder's Office, said that translates into 50 percent of the votes cast plus one." Mr. Busch suggested that the Los Angeles County Registrar-Recorder's Office should be notified by the Commission's legal counsel of the stipulations of the Education Code--that it must be a majority of registered voters or 37,000 "yes" votes.Dr. Klonecky agreed that this type of misinformation should be corrected. The Commission then directed staff to send the Los Angeles County Registrar-Recorder's Office a copy of Attorney Betty Ann Downing's legal opinion (Attachment #2).
